Policies and Procedures for Releasing Plant Germplasm

The University Council, on recommendation of the Commission on Research, unanimously approved a resolution concerning policies and procedures for releasing plant germplasm.

Following is the text of the resolution as adopted by University Council.

WHEREAS, the Virginia Agricultural Experiment Station plays a vital and unique role in funding the development of new plant germplasm; and

WHEREAS, The College of Agriculture and Life Sciences and the Virginia Agricultural Experiment Station desire to revise the existing policies and procedures governing the release of plant germplasm: (1) to insure the continuation of the funds needed by the Virginia Agricultural Experiment Station to support the development of new plant germplasm, (2) to recognize and reward the inventors of new plant germplasm, and (3) to bring the sharing of the revenues generated in the sale of new plant germplasm more in line with University policy which is designed to deal with more traditional forms of intellectual property; and

WHEREAS, the Plant Germplasm Subcommittee of the Intellectual Properties Committee in cooperation with the Plant Germplasm Release Committee undertook to revise the existing policies and procedures to incorporate the desired changes and subsequently included said changes which appear by in-large on pages 10 and 11 of the revised policies and procedures for releasing plant germplasm dated June 18, 1996; and

WHEREAS, the revised policies and procedures were submitted by the Plant Germplasm Subcommittee to the Intellectual Properties Committee during the August 8, 1996 meeting, reviewed and forwarded with a recommendation for approval to the Commission on Research; and

WHEREAS, the Commission on Research has reviewed the recommendation of the Intellectual Properties Committee during the September 11, 1996 meeting and concurs with the recommendation;

THEREFORE BE IT RESOLVED, that the Commission on Research hereby recommends approval of the revised policies and procedures to the University Council of the university.
